Klever Canine Academy LLC

1. Introduction

Welcome to Klever Canines ("Company," "we," "us," or "our"), a provider of professional dog training services. By enrolling in or using our services, including but not limited to board and train programs and private lessons, you ("Client," "you," or "your") agree to comply with the following Terms and Conditions. If you do not agree, please refrain from using our services.

2. Scope of Services

Klever Canines offers a range of dog training programs designed to suit different needs, including but not limited to:

  • Board and Train programs
  • Private Lessons (in-home or on-site)
  • Group Classes
  • Doggy Day Camp
  • Medical Service Dog
  • Puppy training
  • Behavior modification
  • Obedience training

All services are provided by experienced trainers committed to helping you and your dog reach your training goals.

3. Client Responsibilities

1. Accurate Information:

You are responsible for providing truthful, accurate, and up-to-date information about your dog's health, behavior, vaccination status, and training history.

2. Training Participation:

You agree to follow the guidance and training plan provided by our trainers. This includes consistently practicing recommended techniques and exercises outside of training sessions.

3. Damages:

You are responsible for any damage to equipment or property caused by your dog during training sessions. Should your dog damage property or equipment owned by Klever Canines or its trainers, you agree to cover the cost of repair or replacement.

4. AKC Certification Fees

Any certifications from the American Kennel Club (AKC) must be paid by the client according to AKC rules and regulations. Klever Canine Academy does not cover the cost of AKC certification fees, which are separate from our training program fees. Clients are responsible for:

  • All AKC registration and certification fees
  • Any additional AKC processing or administrative costs
  • Compliance with AKC requirements and deadlines
  • Providing necessary documentation for AKC certification

While we provide training that may prepare your dog for AKC certification, the certification process and associated costs are entirely separate from our training services.

5. Liability Waiver

By participating in our training services, you understand and accept that working with dogs carries inherent risks. You agree to:

  • Assume all risks and responsibilities associated with training activities.
  • Indemnify and hold Klever Canines, its trainers, and affiliates harmless from any claims, damages, or liabilities arising from your participation in our services.

6. Refunds and Cancellations

6.1 Before Program Start

  • If you cancel 14 or more days before the scheduled start date of your training program (board and train, private lessons, or others), any applicable deposit or fees may be refunded, subject to our discretion and any prior agreements.
  • If you cancel less than 14 days before the scheduled start date, no refund will be applicable.

6.2 After Program Start

  • Once a program (board and train or private lessons) has begun, you lose the right to cancel unless there are extenuating circumstances such as severe illness or death.
  • If the program must be stopped for reasons beyond our control (e.g., trainer unavailability, dog illness, or holidays), Klever Canines reserves the right to change the start date or pause the program without offering a refund.
  • We have 60 days to provide an alternative start date or resume date. If we are unable to do so within 60 days, you have the right to a full refund.

6.3 Reasons for Schedule Changes Without Refund

  • Trainer becomes unavailable and a replacement must be found.
  • The dog's vaccines are not up to date.
  • National/company holidays or unforeseen closures.
  • The dog arrives sick, or becomes sick, and training must be postponed until recovery.
  • Incomplete or false information provided regarding health status or behavioral issues (e.g., aggression/anxiety).
  • Known behavioral concerns not disclosed prior to commencement.

7. Results Disclaimer

Klever Canines does not guarantee specific results from any training program. Every dog is unique, and many factors (e.g., temperament, environment, owner commitment) can influence outcomes. While we strive to provide comprehensive training and ongoing support, results will vary. We offer lifetime support to help you address challenges beyond the initial program.

8. Lifetime Support

Klever Canine Academy provides lifetime support to all clients who complete our training programs. Our lifetime support includes:

  • Access to training videos of your dog's training sessions
  • Guidance and consultation with our expert trainers via phone calls, email, or text message
  • Ongoing support for questions, concerns, or challenges that may arise after program completion
  • Continued access to our training resources and expertise

This lifetime support is provided as a courtesy to help ensure the long-term success of your dog's training. While we strive to respond to all inquiries in a timely manner, response times may vary based on trainer availability and the nature of the inquiry.

9. Intellectual Property Rights

All content and materials provided by Klever Canines—including, but not limited to, training manuals, instructional videos, and written resources—are protected by copyright laws and remain the exclusive property of Klever Canines LLC. You may not copy, distribute, reproduce, or use these materials without prior written permission from Klever Canines.

10. Confidentiality

Klever Canines respects your privacy. We will not disclose personal information about you or your dog to third parties without your consent. We may use aggregated or anonymized data for research or marketing purposes, but this will not include personally identifiable information.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of Florida. Any disputes or claims arising from your participation in our services shall be resolved through arbitration in accordance with the rules of the American Arbitration Association.

12. Changes to Policy

Klever Canines reserves the right to modify or update these Terms and Conditions at any time. Any changes will be posted on our website and will become effective immediately upon posting.

13. Agreement and Acknowledgment

By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
